Federal judge says Texas voter registration policy violates federal law

[JURIST] Federal judge Orlando Garcia in the US District Court for the Western District of Texas [official website] in San Antonio has granted summary judgment [text, PDF] to a group of voters who argued that the voter registration measures of Texas’ online driver’s license registration system are unconstitutional under “motor voter” provisions of the 1993 National Voter Registration Act (NVRA) [official website].

The plaintiffs claimed that the way Texas administers voter registration through their online driver’s license tool is a violation of NVRA provisions, which require simultaneous options for voter registration with one’s motor vehicle driver’s license application. Texans who went online to update their driver’s license information ran into roadblocks that in-person applicants did not, according to the Texas Civil Rights Project, which brought the suit against Texas in 2016.
