OFCCP Proposes to Rescind Previous Administration’s Religious Exemption Rule

The U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has proposed rescinding a rule put forth during former President Trump’s administration that created a religious exemption to equal opportunity requirements.

The OFCCP enforces Executive Order 11246, which prohibits federal contractors and subcontractors from discriminating on the basis of race, color, religion, sex, sexual orientation, gender identity or national origin. The executive order has a religious exemption for certain religious corporations, associations and educational institutions for the employment of individuals of a particular religion.

The OFCCP’s proposed rescission would preserve the executive order’s religious exemption but return it to the policy and practices in operation during the presidencies of George W. Bush and Barack Obama.
