6th Circuit dissenter warns of ‘tyranny;’ majority upholds abortion ultrasound law

A divided federal appeals court has upheld a Kentucky law requiring doctors who perform abortions to perform ultrasounds that include audio of the heartbeat.
Circuit Judge John Bush, an appointee of President Donald Trump, wrote the April 4 majority opinion rejecting a First Amendment challenge to the law, known as House Bill 2, report Courthouse News Service and the Louisville Courier Journal.

There is no violation of doctors’ right to free speech because the law requires the disclosure of truthful, nonmisleading and relevant information about an abortion, Bush said.
