The Chinese telecommunications giant, Huawei, filed a motion for summary judgment on Tuesday in the US District Court for the Eastern District of Texas to accelerate its lawsuit against the US government.
The lawsuit, initially filed in March, involves Section 889 of the National Defense Authorization Act (NDAA). This provision explicitly prohibits executive government agencies from procuring telecommunications equipment from Huawei and rival ZTE. Huawei argues that the provision in the NDAA unconstitutional since it violates the company’s right to due process.
