On November 26, the FTC announced a proposed settlement with Evolv Technologies, as the company was alleged to have violated Section 5 of the FTC Act by falsely advertising its product’s effectiveness in weapon detection. This settlement is part of the FTC’s broader campaign, “Operation AI Comply,” aimed at ensuring transparent and truthful marketing practices within the emerging AI sector. The accusations against Evolv indicate a pressing need for regulatory scrutiny in the realm of AI technologies, especially those deployed for public safety measures in K-12 schools and other sensitive areas.

As part of the proposed settlement, certain K-12 schools now have the option to opt out of their contracts with Evolv. The settlement also includes provisions that bar Evolv from misrepresenting the performance and cost-efficiency of its screening systems in the future. Additionally, the company is required to adhere to strict recordkeeping, monitoring, and reporting mandates to prevent further misrepresentation.
