The Brazilian Data Protection Law (LGPD) in effect since 2020 is starting to show its effects in the litigation landscape.
Although the Brazilian National Data Protection Agency (ANPD) has been fairly active since it started operating in 2021 to promote and regulate the LGPD, there are many points of the law the ANPD has not yet addressed and the number of audits and fines imposed is still very small for a country with more than 200 million potential data subjects.
